These Terms and Conditions (“Terms”) govern your access to and use of JT's Towing and Recovery website, products, services, applications, content, and related offerings (collectively, the “Services”).

By accessing, browsing, purchasing from, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

“We,” “us,” and “our” refer to JT's Towing and Recovery. “You” and “your” refer to any person or organization using the Services.

2. Eligibility

You must be legally able to enter into a binding agreement to use the Services. If you use the Services on behalf of a company, organization, or other entity, you represent that you have authority to accept these Terms on its behalf.

The Services are not intended for anyone who is under 16 years of age or below the legal driving age in their state of residence. Do not use the Services if you do not meet these age requirements.

However, this age restriction does not prevent a person from accessing the Services solely to seek immediate emergency assistance in a life-threatening situation. This limited exception does not permit any person to drive, operate a vehicle, enter into a contract, or engage in any activity that is prohibited by applicable law. In an emergency, call 911 or the applicable local emergency number first.

3. Changes to These Terms or the Services

We may update these Terms or change, suspend, or discontinue any part of the Services from time to time. Updated Terms will be posted on this page with a revised “Last updated” date. Your continued use after changes take effect means you accept the updated Terms.

If a change materially affects an active paid subscription, we will provide notice where required by law.

4. Acceptable Use

You may use the Services only for lawful purposes and in accordance with these Terms. You must not:

  • Break any applicable law or regulation.

  • Use the Services to harass, threaten, defraud, or harm anyone.

  • Upload or distribute malware, harmful code, or unauthorized advertising.

  • Interfere with the security, operation, or availability of the Services.

  • Attempt to access accounts, data, or systems without permission.

  • Copy, scrape, reproduce, modify, sell, lease, or exploit the Services except as expressly allowed by us or applicable law.

  • Use automated tools to collect information from the Services without our written permission.

  • Impersonate another person or misrepresent your affiliation.

  • Upload material that is unlawful, infringing, defamatory, obscene, hateful, or otherwise inappropriate.

  • Use the Services to develop, train, or improve a competing product or service without our written consent.

5. Intellectual Property

The Services and their contents—including text, graphics, logos, designs, software, photographs, videos, trademarks, and other materials—are owned by or licensed to JT's Towing and Recovery and are protected by intellectual-property laws.

Except for the limited rights expressly granted in these Terms, no rights in the Services or content are transferred to you. You may not use our name, logo, or trademarks without prior written permission.

6. User Content

You retain ownership of content you submit to the Services (“User Content”). However, by submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, modify, display, distribute, and use that content as needed to operate, improve, promote, and provide the Services.

You confirm that you have the rights needed to submit User Content and that it does not violate law or anyone else’s rights.

We may, but are not required to, review, remove, or restrict User Content at our discretion.

7. Feedback

If you send suggestions, ideas, comments, or feedback about the Services, you agree that we may use them without restriction, payment, or obligation to you.

8. Third-Party Services and Links

The Services may include links to or integrations with third-party websites, products, or services. We do not control and are not responsible for third-party content, policies, availability, or practices. Your dealings with third parties are between you and the third party.

9. Privacy

10. Disclaimers

To the maximum extent permitted by law, the Services are provided “as is” and “as available.” We make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, or reliability.

We do not promise that the Services will always be secure, uninterrupted, error-free, or free from harmful components, or that any results obtained through the Services will be accurate or meet your requirements.

Nothing in these Terms excludes rights or warranties that cannot legally be excluded.

11. Limitation of Liability

To the maximum extent permitted by law, JT’s Towing and Recovery and its owners, employees, contractors, affiliates, partners, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunity, arising from or related to your use of the Services.

To the maximum extent permitted by law, our total liability for all claims arising from or related to the Services will not exceed the greater of:

  1. the amount you paid us for the relevant Services during the 12 months before the event giving rise to the claim; or

  2. USD $1,000 /  Total Paid for Services.

This section does not limit liability that cannot be limited under applicable law, including liability for fraud, willful misconduct, or personal injury caused by negligence where such limits are prohibited.

12. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless JT's Towing and Recovery and its owners, employees, contractors, affiliates, partners, and suppliers from claims, liabilities, damages, losses, and expenses arising out of or related to your misuse of the Services, violation of these Terms, violation of law, or infringement of another person’s rights.

13. Suspension and Termination

You may stop using the Services at any time. We may suspend or terminate your access immediately if we reasonably believe you have violated these Terms, created risk or legal exposure, or if required by law.

On termination, your right to use the Services ends. Sections that by their nature should survive termination—including intellectual property, disclaimers, limitation of liability, indemnification, and dispute provisions—will survive.

14. Governing Law and Disputes

These Terms are governed by the laws in the State of Missouri, of the United States of America, without regard to conflict-of-law rules.

Any dispute arising from these Terms or the Services will be brought exclusively in the courts located in the City of Cuba, located in the county of Crawford, in the State of Missouri, of the United States of America, unless applicable law requires otherwise.

Optional alternative: Before filing a formal claim, both parties agree to try in good faith to resolve the dispute informally by contacting mreeves.jttowing@gmail.com and allowing at least 30 days for resolution.

Arbitration and Class-Action Waiver

Except where prohibited by applicable law, any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration rather than in court.

The arbitration will be administered by [arbitration provider] under its applicable rules. The arbitration will take place in City of Cuba, located in the county of Crawford, in the State of Missouri, of the United States of America, unless the parties agree otherwise or applicable law requires another location.

You and JT's Towing and Recovery agree that claims may be brought only on an individual basis and not as part of a class, collective, consolidated, representative, or private-attorney-general action. The arbitrator may award the same individual remedies that a court could award, but may not award relief for or against anyone other than the individual parties.

Either party may bring an eligible claim in small-claims court. Either party may also seek temporary or emergency court relief to protect intellectual-property rights, confidential information, or prevent unauthorized access to the Services.

You may opt out of this arbitration agreement by sending written notice to mreeves.jttowing@gmail.com within 30 days after first accepting these Terms. Your notice must include your name, contact information, and a clear statement that you wish to opt out of arbitration.

Nothing in this section limits consumer protections or rights that cannot legally be waived.

15. Consumer Rights

Nothing in these Terms is intended to limit or exclude consumer rights that cannot be waived under applicable law. If you are a consumer, you may have additional cancellation, refund, warranty, or dispute-resolution rights depending on where you live.

16. Electronic Communications

You agree that we may communicate with you electronically, including through email, notices on the Services, or account messages. Electronic communications satisfy legal requirements that communications be in writing where permitted by law.

17. General Terms

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect.

Our failure to enforce a provision is not a waiver of our right to enforce it later.

You may not transfer your rights or obligations under these Terms without our written consent. We may transfer our rights and obligations in connection with a merger, acquisition, sale of assets, or operation of law.

These Terms, together with any policies or additional terms expressly incorporated by reference, form the entire agreement between you and JT's Towing and Recovery regarding the Services.
