1. General Liability Disclaimer

By requesting or authorizing towing, recovery, transport, roadside assistance, or related services, the customer certifies that they are the vehicle owner or have the legal authority to authorize such services.

The towing company agrees to exercise reasonable care and use industry-standard practices while performing services. However, the customer acknowledges that towing and recovery operations involve inherent risks. The company is not responsible for pre-existing damage, mechanical or electrical failures, hidden defects, aftermarket modifications, normal wear and tear, or damage resulting from the vehicle's condition, acts of nature, road hazards, traffic conditions, or other circumstances beyond the company's reasonable control.

The customer agrees to release and hold harmless the towing company, its owners, officers, employees, contractors, and agents from any claims, liabilities, damages, losses, or expenses arising out of or related to the towing, transport, recovery, storage, or roadside services provided, except to the extent such claims result from the company's gross negligence, willful misconduct, or where liability cannot be waived under applicable law.

The customer further agrees that any claim for alleged damage must be reported to the towing company before the vehicle is removed from the delivery location or released from storage whenever reasonably possible.

2. Personal Property Disclaimer

Customers are responsible for removing all personal belongings, valuables, cash, firearms, medications, documents, electronic devices, and any other personal property from the vehicle before it is towed, transported, or placed into storage.

The towing company is not responsible for the loss, theft, damage, or disappearance of any personal property left in or on the vehicle before, during, or after towing, transport, recovery, or storage, except where such loss or damage is caused by the company's gross negligence or willful misconduct, or as otherwise required by applicable law.

If the customer is unable to remove personal property before service due to emergency circumstances, the customer acknowledges that the company cannot guarantee the security or condition of items left in the vehicle.

3. Vehicle Condition Disclaimer

The customer acknowledges that the vehicle may have pre-existing damage, mechanical defects, worn or deteriorated components, aftermarket modifications, or structural weaknesses that are not readily visible.

The towing company will use reasonable care and industry-standard towing and recovery practices; however, it is not responsible for damage resulting from pre-existing conditions, normal towing and transport operations, mechanical or electrical failures, rust or corrosion, weakened suspension or steering components, defective tires, broken or seized parts, fluid leaks, or aftermarket equipment that may fail during service.

The customer authorizes the towing company to use the towing, loading, unloading, transport, and recovery methods deemed appropriate for the circumstances. The company is not liable for damage caused by unsafe vehicle conditions, hidden defects, or circumstances beyond its reasonable control, except where caused by the company's gross negligence or willful misconduct, or as otherwise required by applicable law.

4. Winching and Recovery Disclaimer

Winching and vehicle recovery services involve inherent risks due to factors such as terrain, weather, road conditions, vehicle position, and the condition of the vehicle. By authorizing recovery services, the customer acknowledges and accepts these risks.

The towing company will use reasonable care, appropriate equipment, and industry-standard recovery methods. However, the company is not responsible for damage resulting from pre-existing vehicle conditions, weakened structural components, rust or corrosion, aftermarket modifications, hidden defects, shifting cargo, or damage that is unavoidable due to the circumstances of the recovery.

The customer authorizes the towing company to determine the recovery methods and equipment necessary to safely recover and transport the vehicle. The customer understands that recovery operations may require pulling, lifting, winching, repositioning, or other specialized techniques that could result in additional damage when such damage is unavoidable due to the vehicle's location or condition.

The customer agrees to release and hold harmless the towing company, its owners, officers, employees, contractors, and agents from claims arising out of winching and recovery services, except where such claims are caused by the company's gross negligence, willful misconduct, or where liability cannot be waived under applicable law.

5. Payment Disclaimer

Payment is due in full upon completion of services unless prior written billing arrangements have been approved by the towing company.

The customer agrees to pay all applicable charges for towing, recovery, winching, roadside assistance, mileage, labor, storage, after-hours service, administrative fees, tolls, and any other authorized services or expenses incurred.

Vehicles placed into storage are subject to daily storage fees beginning as permitted by applicable law. Additional fees may apply for vehicle release, after-hours retrieval, or other services as allowed by law.

The towing company reserves the right to retain possession of the vehicle until all lawful charges have been paid in full, where permitted by applicable law. Unpaid accounts may be subject to collection efforts, and the customer may be responsible for reasonable collection costs, attorney's fees, court costs, and applicable interest where authorized by law.

Accepted methods of payment are determined by the towing company. Returned checks, chargebacks, or declined payments may be subject to additional fees as permitted by law.

6. Authorization Disclaimer

By requesting, authorizing, or accepting towing, recovery, transport, storage, lockout, roadside assistance, or any related services, the customer certifies that they are the registered owner of the vehicle or have the legal authority to request and authorize such services on behalf of the owner.

The customer represents that all information provided to the towing company is true and accurate. If requested, the customer agrees to provide valid government-issued identification, vehicle registration, proof of ownership, insurance information, or other documentation reasonably necessary to verify authorization.

If it is determined that the customer did not have the legal authority to authorize services, the customer agrees to indemnify and hold harmless the towing company, its owners, officers, employees, contractors, and agents from any claims, damages, liabilities, costs, or expenses, including reasonable attorney's fees, arising from the unauthorized request for services.

The towing company reserves the right to refuse or discontinue services if ownership or authorization cannot be reasonably verified or if performing the requested service would violate applicable law or company policy.

7. Release of Liability

By requesting, authorizing, or accepting towing, recovery, transport, storage, lockout, roadside assistance, or related services, the customer acknowledges that such services involve inherent risks and voluntarily assumes those risks.

The customer agrees to release, waive, and hold harmless the towing company, its owners, officers, employees, agents, contractors, and affiliates from any and all claims, demands, damages, losses, liabilities, costs, or expenses arising out of or related to the services provided, including towing, recovery, transport, storage, loading, unloading, or roadside assistance, except to the extent such claims result from the company's gross negligence, willful misconduct, or where liability cannot be waived under applicable law.

The customer further acknowledges that the towing company is not responsible for damage resulting from pre-existing vehicle conditions, hidden defects, mechanical or electrical failures, aftermarket modifications, normal wear and tear, acts of nature, road hazards, or circumstances beyond the company's reasonable control.

The customer agrees to inspect the vehicle upon delivery or release, whenever reasonably possible, and to promptly report any alleged damage before the vehicle is removed from the delivery location or released from storage.

This release shall be binding upon the customer and their heirs, representatives, successors, assigns, insurers, and any person or entity claiming through or on behalf of the customer.

8. Storage Disclaimer

Vehicles left in the towing company's storage facility are subject to daily storage charges beginning at the time permitted by applicable law. Additional charges may apply for vehicle release, after-hours retrieval, administrative processing, specialized equipment, or other authorized services.

The registered owner or authorized representative is responsible for all towing, recovery, storage, administrative, and related fees incurred before the vehicle will be released, unless otherwise required by applicable law.

The towing company is not responsible for the loss, theft, or damage of personal property left in or on the vehicle while it is in storage, except where such loss or damage is caused by the company's gross negligence, willful misconduct, or as otherwise required by law. Customers are encouraged to remove all personal belongings as soon as legally permitted.

Vehicles remaining in storage beyond the time allowed by applicable law may be considered abandoned and may be subject to lien, sale, or disposal in accordance with applicable state and local laws. The customer is responsible for all accrued charges and costs associated with the storage and disposition of the vehicle as permitted by law.

The towing company reserves the right to require proof of ownership, valid government-issued identification, and payment of all lawful charges before releasing any vehicle.

9. Roadside Assistance Disclaimer

By requesting roadside assistance services, including but not limited to battery jump-starts, tire changes, fuel delivery, lockout services, winching, and minor roadside repairs, the customer certifies that they are the registered owner of the vehicle or have the legal authority to authorize such services.

The towing company will perform roadside assistance services using reasonable care and industry-standard practices. However, the company does not guarantee that the requested service will resolve the vehicle's mechanical, electrical, or operational issues or make the vehicle safe or roadworthy.

The customer acknowledges that roadside assistance services may expose pre-existing defects, worn or damaged components, or mechanical and electrical failures. The towing company is not responsible for damage or failures resulting from pre-existing conditions, defective parts, aftermarket modifications, normal wear and tear, or circumstances beyond the company's reasonable control.

The customer agrees to release and hold harmless the towing company, its owners, officers, employees, contractors, and agents from any claims, damages, losses, or liabilities arising from the roadside assistance services provided, except where such claims result from the company's gross negligence, willful misconduct, or where liability cannot be waived under applicable law.

The customer understands that certain roadside assistance services may be declined if the conditions present an unreasonable safety risk to the operator, the customer, the public, or the vehicle.

10. Vehicle Lockout Service Disclaimer

By requesting and accepting vehicle lockout services, the customer certifies that they are the registered owner of the vehicle or have the legal authority to authorize entry into the vehicle.

The customer understands that lockout services may require the use of specialized tools to gain entry. While every reasonable precaution will be taken to avoid damage, the customer acknowledges that certain vehicles, especially those with aftermarket accessories, damaged weather stripping, or pre-existing mechanical or electrical issues, may present additional risks. The company is not responsible for damage resulting from pre-existing conditions, defective locks or door mechanisms, vehicle modifications, or circumstances beyond its reasonable control.

The customer agrees to release and hold harmless the company, its owners, employees, and agents from any claims, damages, or losses arising from the performance of lockout services, except where caused by the company's gross negligence or willful misconduct, or as otherwise required by applicable law.

11. Photo Documentation Notice

To protect both the customer and the towing company, photographs and/or video recordings of the vehicle may be taken before, during, and after towing, recovery, transport, storage, or roadside assistance services.

These images may document the vehicle's condition, existing damage, vehicle location, cargo, license plate, vehicle identification number (VIN), odometer (when accessible), and the services performed. Photographs and recordings may be used for quality assurance, insurance claims, customer service, billing, legal proceedings, regulatory compliance, and to document the condition of the vehicle before and after service.

By requesting or authorizing services, the customer acknowledges and consents to the documentation of the vehicle as described above. The customer understands that these photographs and recordings are the property of the towing company and may be retained in accordance with the company's record retention policies and applicable law.

The towing company will make reasonable efforts to protect the confidentiality of any images and will disclose them only as necessary to conduct business, comply with legal obligations, respond to insurance claims, or protect the company's legal interests.
